LAS VEGAS (AP) — Prosecutor Calls Death PLAN TO SEE Punishment for Las Vegas man accused of murdering girlfriend's 4-year-old son and hiding corpse in freezer - Boy's sister writes note to teacher that mother is being held captive at man's house

Brandon Lee Toseland, 36, has been incarcerated since his arrest in February and has been charged with murder, kidnapping, child abuse, and murder. A trial is scheduled for December after pleading not guilty to a domestic assault charge involving strangulation.

Prosecutor Michelle Fleck on Tuesday declined to comment on her notice of intent to seek the death penalty filed in Clark County District Court on Aug. 11.

Toseland's defense attorney, Craig Mueller, did not immediately respond to her message seeking comment.

A lawyer who represented the boy's mother alleges that the girl was physically, sexually and emotionally abused by Toseland. The woman has not been held criminally responsible for the boy's death.

Her mother filed a wrongful death and negligence suit against Toseland in her March. He countered that his mother knew the boy died in December and said he would help Toseland "save" the body.

The Clark County coroner said he was 7. In May, the boy died of blunt force injuries and his death was ruled a homicide.
