Off-camera voices incorrectly state that the arrest is due to Burke's opposition to "transgender ideology."

Some social media users have misrepresented the situation, claiming that Burke was arrested for not endorsing transgender views or acknowledging LGBT pronouns. However, official sources have clarified the actual reason for the arrest.

The Courts Service in Ireland confirmed that Burke's detention was a result of breaching the terms of an injunction ordering him to stay away from the school. The Garda Síochána, Ireland's national police service, executed a High Court order in Mullingar, County Westmeath, detaining a man who subsequently appeared before the court.

This recent arrest is part of a longer legal saga involving Burke. The initial court order dates back to August 2022, when he was placed on paid administrative leave pending a disciplinary process related to a dispute over a transgender student's pronouns. Burke was first arrested and jailed in September 2022 for violating this order.

In 2023, the High Court granted a permanent injunction requiring Burke to keep away from the school. Despite this, he was imprisoned again in September 2023 for repeatedly appearing at the school. A judge ordered his release in June 2024.
