New Mexico Sues Snapchat Over Child Exploitation Concerns

New Mexico has initiated legal action against Snap Inc, the parent company of Snapchat, alleging that the popular messaging app's policies and design features contribute to the dissemination of child sexual exploitation material. This lawsuit, filed on September 5, 2024, follows a comprehensive investigation by the state's Department of Justice.
Attorney General Raul Torrez's office claims that Snapchat serves as a primary platform for sextortion, a practice where predators coerce minors into sharing explicit content under threats of distribution or financial demands. The investigation included the creation of a decoy account representing a 14-year-old, which interacted with users with explicit usernames, highlighting the app's potential risks.
Snap Inc responded to the allegations, stating that they are reviewing the complaint and will address it in court. The company emphasized its substantial investment in trust and safety measures, reportedly allocating hundreds of millions of dollars to these efforts. Snap also expressed its commitment to ongoing collaboration with law enforcement and online safety experts.
Snapchat, known for its popularity among younger users and its signature disappearing messages feature, has faced scrutiny over its safety measures. The app, which boasts over 750 million monthly active users worldwide as of 2023, has a significant impact on youth communication.
"Snap has misled users into believing that photos and videos sent on their platform will disappear, but predators can permanently capture this content and they have created a virtual yearbook of child sexual images that are traded, sold, and stored indefinitely."
The investigation also uncovered 10,000 records related to Snapchat and child sexual abuse content on dark web sites, with the platform reportedly being the largest source of such material among the investigated sites.
This legal action follows a similar lawsuit filed by New Mexico against Meta Platforms in December 2023, addressing comparable concerns about child protection on social media platforms.
Since its founding in 2011, Snapchat has introduced various safety features, including end-to-end encryption for snaps in 2018 and parental controls. However, the platform's core features, such as disappearing messages and the "Streaks" system, have faced criticism for potentially encouraging risky behavior among young users.
