New York (AP) — Police said a three-year-old boy died after falling off a balcony on the 29th floor of an apartment in New York City on Saturday morning.

Police officers found an injured infant lying on a scaffolding on the third floor after receiving a 911 call at 11:09 am. The boy was taken to a nearby hospital where he was sentenced to death.

"We believe the child came out of the window, but we are investigating how that happened at the time," a police spokesman told The Associated Press. The apartment is located in the Taino Towers Housing Complex in Harlem.

New York City law states that owners of buildings with three or more apartments require a window guard if a child under the age of 10 lives there, or if a tenant or resident requires a window guard. If you do, you are required to have a window guard. It is unknown if window guards are installed in this particular apartment.

A spokesperson said the child's death was under "aggressive investigation" and police were talking to two individuals who were in the apartment when the boy fell.
