Gilbert, a Reno attorney who was outside the Capitol during the January 6, 2021 riots, gave Lombardo his 11 percent, So he finished second by about 26,000 votes.

He was seeking a recount of the hand ballots that he claimed, without any evidence, would result in him winning the Republican nomination by more than 55,000 votes. Gilbert's campaign had individually already paid for a recount that showed no change in overall results.

Las Vegas Sheriff and Donald Trump Lombardo, backed by the former president, is about to sack first-term Democratic governor Steve Sisolak in the November general election.

Carson City District Court Judge James Wilson announced his decision from the bench at a situation hearing Wednesday afternoon. was not The Nevada Independent was the first to report the ruling.

Lombardo declined to comment on the judge's ruling in a brief campaign statement emailed to The Associated Press, saying it was "time to take back our state."

Gilbert did not immediately respond to a request for comment on Wednesday.

A former boxer who enjoyed support from the far-right Republican Party, he campaigned on the false claim that the 2020 election was stolen from Trump, but Lombardo never did.

Gilbert's lawsuit, filed last month in state district court in Carson City, was based largely on mathematical formulas and algorithms, with results certified by every county in the state being erroneous.

Gilbert said earlier this month that he would never allow Lombardo a primary. He argued that his challenge to results was not about his defeat but about the integrity of the election as a whole.

Gilbert's refusal to concede was condemned by many prominent Republicans. Nevada Republican Party Chair Michael McDonald said Gilbert had the right to sue, but he abandoned the effort and decided to join forces with other Republicans to support Lombardo's campaign.

Former Dean Heller, who lost his seat to Democrat Jackie Rosen in 2018 and finished third in this year's primary in June's GOP gubernatorial primary. Senators recently said one Gilbert submission "can be counterproductive in most cases and can seriously damage the reputation of the Republican Party."

Heller was Nevada's Secretary of State in 1998 when he oversaw the most famous recount in Nevada's electoral history. The recount saw Democratic Senator Harry Reid defeat Republican John Ensign by 428 votes behind him in a recount that lasted six weeks from Election Day.
