No charges will be filed in fatal police shooting in Lachine, DPCP says

Quebec’s director of criminal and penal prosecutions (DPCP) has determined that no criminal charges will be filed in a fatal police shooting that occurred in Lachine more than a year ago.

A man was shot on Des Érables St. early in the afternoon of Dec. 16, 2021, after the Montreal police responded to a 911 call. According to a release issued by the DPCP on Tuesday, the person who called 911 reported that the man had attacked two people with a box-cutter knife inside a rooming house.

The man who was killed was not identified by the DPCP.

When police officers arrived, a decision was made to act immediately and two pairs of police officers lined up to head into the building. The stairway into the building was narrow and the man the police were looking for was on the second floor.

“While they were on the steps of the stairs, the police identified themselves, asking the man to collaborate, but in vain. The duo at the back of the line fell back outside the building in order to give the two in front more space,” the DPCP wrote. “One of the officers saw the man and deployed his conducted energy weapon. However, it failed to reach the man.”

The first pair of officers who entered the building also retreated toward the exit when the man advanced toward them.

“At that moment, two officers fired and hit the man with several bullets. Care was provided to him promptly, but he was declared dead at the hospital,” the DPCP wrote, while adding it considers that “the intervention was legal” and that the officers’ use of their firearms was justified.

“After examining the report produced by the Bureau of Independent Investigations, the DPCP concludes that the analysis of the evidence does not reveal the commission of a criminal offence by the Montreal police officers.

“In this case, the police had the legal authority to act since they had information that the man was armed with a (knife) and that he had attacked a man and a woman. Therefore, they had to do everything possible to put an end to the threat. For this reason, they intervened without delay.”
