The prosecution will be seeking the death penalty in relation to Omar Green, who is charged with the murder of his nine-year-old stepdaughter, Nikita Noel, on February 1.
A copy of the notice was served on the defendant when he made his appearance in court on Tuesday.
When the matter was called up in the Hanover Parish Court, the Director of Public Prosecutions entered a nolle prosequi discontinuing the matter in the Parish Court and shortly thereafter preferred a voluntary bill of indictment against Mr. Green in the Hanover Circuit Court.
Mr. Green is charged with murder in the course or furtherance of rape.
The accused had been in an intimate relationship with the mother of the deceased.
