Defence attorneys representing four police officers, including murder-accused Constable Noel Maitland, who are accused of breaching the curfew order under the Disaster Risk Management Act, are to reappear in the Kingston and St. Andrew Parish Court on December 15.
Kevoner Charley, Corwyn Moodie, Ajani Willoughby, Maitland and former cop Dumar Ducally are accused of attending an illegal party on April 29, last year.
Prior to Wednesday's adjournment, attorney Christopher Townsend, who is representing Moodie, Willoughby and Ducally, and attorney Able-Don Foote, who is representing Maitland and Charley, made submissions for the charges to be dismissed.
Following the hearing, Mr. Townsend told Radio Jamaica News that the attorneys argued that a police constable is exempted under the DRMA legislation, which means the officers cannot be brought to court on charges of breaching the curfew order.
"The judge has reserved to look at the matter and invite the clerk to examine the matter," he said.
It was alleged that about 8:20 p.m. on April 29, last year, police attached to the St. Andrew North division received information about an illegal party at a car mart along Constant Spring Road.
The police arrived at the location and locked the doors of the venue, preventing patrons from leaving the compound.
Allegations are that the four lawmen went to the gate and indicated that they were at the premises for various reasons.
