One Don Gang trial: Judge accepts main witness's account of double murder

Chief Justice Bryan Sykes, in continuing his summation in the One Don Gang trial, indicated on Tuesday that the testimony of the former don turned state witness in connection with the murder of a couple in Spanish Town, St. Catherine in 2017, coincides with the account of a relative who had detailed the ordeal.

The couple, Jermaine Bryan and Cedella Walder, were shot up in September 2017, and their wooden dwelling burnt to rubble by the alleged members of the gang.

The witness, during his testimony in court, detailed the planning and execution of the murder of the couple.

Wrapping up his summation Tuesday morning on counts seven and eight, which speak to the double murder, Justice Sykes said the sequence of events given by the community witness in regards to the kicking in of the gate, then door and shots being fired coincided with the former gangster's account.

Justice Sykes said the evidence suggests that the former don was in fact at the scene.

At the same time, the Chief Justice has indicated that the DNA evidence presented to the court about Ms Walder and Mr. Bryan is insufficient in proving their identity.

According to Justice Sykes, the DNA on its own is not conclusive. He said there needs to be further assessment of the evidence to prove that the victims are who the crown has sought to establish that they are.

But Justice Sykes said even if the crown failed to prove the victim's identity, the counts still stand.

He pointed out that names and identities are not a legal necessity to prove the case.
