Preliminary proceedings in Keith Clarke case to continue on April 13

A case management hearing of the preliminary process for the three soldiers charged with killing businessman Keith Clarke in 2010, is to continue on April 13.

Mr. Clarke was reportedly shot 21 times inside his Kirkland Heights home in St. Andrew on July 27, 2010, during a military operation.

Corporal Odel Buckley, Lance Corporal Greg Tingling and Private Arnold Henry had their bail extended when they appeared in the Home Circuit Court on Thursday.

During the case management hearing, the attorneys representing the trio confirmed that they have received disclosure.

Director of Public Prosecutions Paula Llewellyn is to reveal in writing to the defence the list of witnesses to be called at the preliminary process on or before March 31.

Mr. Buckley is represented by attorney Peter Champagnie KC.

Mr. Tingling is represented by Valerie Neita-Robertson KC and Mr. Henry is represnted by Linton Gordon.

The trial was stalled in 2018 after the defence surprised the Crown with certificates of immunity, which they claimed shielded the trio from prosecution.

The certificates were signed in 2016 by then Minister of National Security Peter Bunting, six years after Clarke's death.

The Court of Appeal order stated that a preliminary process should be conducted by a judge, sitting without a jury before an arraignment or trial.
