Court begins hearing into case challenging processes to enact Constitution (Amendment) Act 2022: Defendants seeks to strike out

The High Court started its hearing into the civil case challenging the legality of the parliamentary processes taken in passing the Constitution (Amendment) Act 2022.

The Constitution (Amendment) Act 2022 passed by parliament on 8th September 2022 provides for the extension of the current parliament until next 2024.

Public gathered at the High Court

Civil case, 313 of 2023 filed by the claimant, the Leader of Independent Group, Hon John Dean Kuku against the defendants, the Speaker of the National Parliament, Prime Minister and Governor General seeks a judicial review of the processes taken in passing the act.

In Court this afternoon, Chief Justice Sir Albert Palmer heard the defendants’ intentions for strike out applications.

He then ordered both parties to make their submissions within 7 days.

The case was then adjourned to 31st August 2023 to hear the defendants’ applications to strike out.

Lawyer Billy Titiulu is representing Hon Dean Kuku while Wilson Rano and Savenaca Banuve are representing the defendants.
