MBABANE – Mbabane Citizens boss Bheki ‘Rubber’ Simelane denies ever assaulting PLS executive member Sicelo Mkhonta.
Simelane, through his lawyers Mbuso E. Simelane and Associates, has filed a notice of appeal with the Football Association (FA), wherein he seeks a review of the E20 000 summary fine he was slapped with by the Premier League of Swaziland. On May 16, 2018, the PLS served Simelane with a letter, to the effect that his team, Citizens, was summarily fined E20 000 for violent misconduct.
“Mbabane Citizens is hereby summarily fined E20 000 for violent misconduct, in that on May 13 at Somhlolo National Stadium, the accused team’s official and/or supporter Bheki Simelane assaulted PLS executive member Sicelo Mkhonta,” read the fine notice which has been attached in the appeal papers.
In response, Citizens wrote to the FA seeking match officials or the stadium representative’s reports, where the alleged assault could have been recorded in a letter dated May 22, 2018.
It is alleged that Simelane assaulted Mkhonta after their respective sides’ Citizens and Manzini Sea Birds’ last game of the season on May 13.
Sea Birds won the match to pip Citizens from the MTN National First Division log summit but both teams have been promoted to the Premier League.
In their founding affidavit annexed in the Notice of Appeal, Citizens, through Secretary General Sifiso Hlatshwayo, argue that the E20 000 summary fine against the applicant was without due process of a hearing as envisaged by natural justice, the Constitution of Swaziland 2005 and the 2017/18 rules and regulations of the MTN National First Division.
