Oklahoma state rep yells ‘You can’t detain me!’ during public drunkenness arrest

An Oklahoma state representative was caught on film yelling at police that they couldn’t arrest him for public drunkenness because he is a politician and above the law.

Dean Davis, 50, ran into the police last Thursday when he and some friends refused to leave the Skinny Slims bar, in Broken Arrow.

Although the bar was closed, the group continued to drink on the outdoor patio.

Davis, a Republican, appeared insulted and confused in newly released bodycam videos, with the politician demanding the arresting officers call their supervisors and warning them of consequences to come.

“You chose the wrong person, congratulations” Davis can be heard telling the officers as he claimed he was “privileged from arrest during the session of the Legislature.”

The police ignored the entitled politician as they handcuffed him and took him to jail.

“You can’t detain me!” Davis cried, realizing the officers didn’t care about his position.

‘I can, and I am right now,’ Sgt. Timothy Brewer responded. 

Oklahoma City Police said no one had called to complain about Davis and his friends, but it was rather Brewer and a police lieutenant who spotted the group while patrolling the area at 2 a.m. last Thursday.

The officers warned the group to move out of the closed business, but said the group refused and “became argumentative.”

That’s when Davis pulled out his wallet to show his legislative credentials and warned the officers that they had “messed up.”

In his report on the arrest, Brewer noted that an employee from the bar had also asked the group to leave prior to closing, but that they ignored her and said they were a group of lawmakers.

Additional footage from inside the patrol car shows how Davis continued to argue against Brewer, demanding how he could arrest him without conducting a breathalyzer test first.

“There’s nothing to answer,” Brewer told Davis. “Your speech is slurred, you’ve got the smell of alcohol on your breath and you can’t understand or obey simple instructions.”

Davis has denied any wrongdoing in the matter.

He did not immediately respond to The Post’s request for comment.

The politician alleges that he was not drinking alcohol at the time of the arrest, a claim backed up by fellow state Rep. T.J. Marti, who was at the bar that night, Non Doc Friday reports.

The Oklahoma City Fraternal Order of Police, which Davis had warned would have his back on the night of the arrest, has instead backed Brewer and commended the officer.

“The detention and arrest of Rep. Davis were completely justified,” Mark Nelson, the group’s president, said in a statement.

“Our officers must deal with circumstances that are difficult and require much patience. We are proud of how Sgt. Brewer represented himself and the police department.”

Thursday’s arrest was the second time Davis has been booked since taking office in 2019. Last September, he was placed on probation for a 2019 DUI, where he was accused of driving while impaired, speeding and obstructing a police officer.
