Chamber judge of the Appellate Division of the SC Justice M Enayetur Rahim passed the order following a writ petition filed by Awami League-nominated chairman candidate Abdul Wadud Pintu seeking stay on the High Court order that allowed independent candidate Alabox Taher Titu -- a bank loan defaulter -- to contest the election for the same post.

The apex court chamber judge also sent the petition of Abdul Wadud Pintu to the full bench of the court for its hearing on October 17, Alabox Taher's lawyer Md Ruhul Quddus Kazal told The Daily Star.

Awami League nominated chairman candidate Abdul Wadud Pintu submitted the petition to the Appellate Division challenging the HC order on September 25 that allowed Alabox Taher Titu to contest the election.

In the petition, he said that Alabox Taher Titu is a bank loan defaulter and therefore, he cannot be allowed to contest the election under the relevant law.

Senior lawyer Md Momtaz Uddin Fakir appeared for Abdul Wadud Pintu during hearing of the petition.
